Breaktime Media MWH LLC (“Dailybreak,” “we,” “us,” “our”) provides its services to you through its website located at www.dailybreak.com (the “website”) and related services (collectively, such services, including any new features and applications, and the website, the “Service(s)”), subject to this Privacy Policy (as amended from time to time, this “Policy”). By accessing or using the Services or by registering as a member of the Services, you consent to the collection and use of your personally identifiable information (“Personal Data”) as described in this Policy. This Policy applies to all users of the Services, including users who are also registered members. If you are unwilling to consent to our collection and use of your Personal Data as described in this Policy or to accept the terms and conditions of the Terms of Use located at https://www.dailybreak.com/terms, you should not use the Services.
What information do we collect?
When you interact with us through the Services, we collect Personal Data and certain other information about you in a few different ways:
1. When you give it to us or give us permission to obtain it.When you register for or use our Service, you voluntarily provide certain information. This can include, without limitation, your name, telephone number, physical address and email address. It may also include other information you provide to us in your other transactions or experiences with Dailybreak or its affiliates, including comments and information you may submit when utilizing the “social networking” aspects of the Service or when emailing us. By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Policy. If you provide Personal Data to the Service, you acknowledge and agree that such Personal Data may be transferred from your current location to our offices and servers and the authorized third parties referred to herein located in the United States.
2. We collect technical information when you use our ServicesAs is true of most websites and applications, Dailybreak may gather specific information automatically through the Service. Here are some of the types of information we collect:
Log data: When you use the Service, our servers automatically record information (“log data”), including information that your browser sends whenever you visit a website or your mobile app sends when you’re using it. This log data may include your Internet Protocol address, the address of the web pages you visited, browser type and settings, the date and time of your request, and cookie data. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. We may store such information itself or such information may be included in databases owned and maintained by our affiliates, agents or service providers. The Service may use such information and pool it with other information to track, for example, the total number of visitors to the website, the number of visitors to each page of the website, and the domain names of our visitors' Internet service providers. It is important to note that no Personal Data is available or used in this process.
Cookie data: A cookie is a piece of information that the computer that hosts the Service gives to your browser when you access the Service. Dailybreak uses cookies to track non-personally identifiable information about visitors to the Services in the aggregate, so that Dailybreak can learn which advertisements and Services features are being relied upon, analyze trends, administer the Services, track users’ movements around the site and gather demographic information about the user base as a whole. In all cases in which we use cookies, we will not collect Personal Data except with your permission. On most web browsers, you will find a “help” section on the toolbar. Please refer to this section for information on how to receive notification when you are receiving a new cookie and how to turn cookies off. We recommend that you leave cookies turned on because they allow you to take advantage of some of the Service’s features.
Spotlight Tags: Dailybreak may also use spotlight tags, which are transparent GIF files embedded in the Services, to help manage and track the effectiveness of online advertising. Spotlight tags enable the recognition of a unique cookie on your web browser, which in turn enables us to learn which advertisements bring users to the Services. The cookie would be placed by us, or by another advertiser who works with us. The information that we may collect via spotlight tags and share is anonymous and not personally identifiable.
Geo-Location Information: Our Services may collect and use your location information (for example, by using the GPS on your mobile device) to provide certain functionality of our Services. If you choose to enable our location features, your location information may be publicly displayed within the Services. Please keep in mind that other users can see this information about you, and they may use it or disclose it to other individuals or entities outside of our control and without your knowledge. Your location information may be subject to abuse, misuse, and monitoring by others, so please be careful if you choose to enable location functionality. We may also use your location information in an aggregate way, as described below.
Sometimes our partners may let us collect information when you use their services, or may share with us the information they collect. For example:
Some partner sites may run Dailybreak Services, so we may collect log information (described above) from those sites or apps
Online advertisers typically share information with the websites or apps where they run ads to measure and/or improve those ads. We also receive this information, which may include information like whether clicks on ads led to purchases or a list of criteria to use in targeting ads.
How do we use the information we collect?
We use the information we collect to deliver our Services to you, improve them, develop new products, and protect Dailybreak and our users. We also use the information we collect to offer you customized content, including:
- Suggesting content or promotions that you may be interested in based on usage patterns
- Displaying ads you might be interested in
- Responding to your questions or comments
In an ongoing effort to better understand and serve the users of the Services, we may conduct research on our customer demographics, interests and behavior based on the Personal Data and other information provided to us. What choices do you have about your information?
Our goal is to give you simple and meaningful choices over your information. If you have a Dailybreak account, many of the choices you have on Dailybreak are built directly into the product or your account settings. For example, you can:
- Access and change information in your profile page at any time
- Link or unlink your Dailybreak account from an account on another service (e.g., Facebook or X)
- You may not be able to use certain Services if you decide not to disclose Personal Data
How and when do we share information?
We may share your Personal Data or other information in the following circumstances:
- When we have your consent. This includes sharing information with other services (like Facebook or X) when you’ve chosen to link to your Dailybreak account to those services or publish your activity on Dailybreak to them.
- We may engage third parties to perform services in connection with the operation of our business. These services may include, but are not limited to, product or experience customization, data collection, storage, management, analysis, cleansing, distribution of marketing and promotion material, website evaluation and other services designed to assist us in maximizing our business potential.
- Online advertisers and researchers typically use third party companies to audit the delivery and performance of their ads on websites and apps. We also allow these companies to collect this information on Dailybreak.
- If we believe that disclosure is reasonably necessary to comply with a law, regulation or legal request; to protect the safety, rights, or property of the public, any person, or Dailybreak; or to detect, prevent, or otherwise address fraud, security or technical issues.
- We may share the information described in this Policy in connection a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction or proceeding.
We may also share information, including Personal Data, with our partners, advertisers, or others, including for commercial and marketing purposes. Applicable California privacy legislation permits visitors who are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. To make such a request to access such information, please contact us at support@dailybreak.com. Within thirty (30) days of receiving such a request, we will provide a list of the categories of Personal Data disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the address specified in this paragraph.
Protection of information
We strive to maintain the reliability, accuracy, completeness and currency of your Personal Data in our databases and to protect the privacy and security of our databases and the data we collect. Any Personal Data that you provide to us will be stored on our computer network servers. We maintain reasonable physical, electronic and procedural safeguards to protect the confidentiality of your Personal Data. The security measures in place on the Services and related computer systems aim to protect the loss, misuse or alteration of the information you provide to us. We do not knowingly collect Personal Data from children under the age of 17. If you are under the age of 17, please do not submit any Personal Data through the Service. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide Personal Data on the Service without their permission. If you have reason to believe that a child under the age of 17 has provided Personal Data to us through the Service, please contact us, and we will endeavor to delete that information from our databases.
